Air Ambulance Service Contract

This Air Ambulance Service Contract (Hereinafter referred to as “Contract“) shall be considered as an integral part of the Air Ambulance Flight Quotation submitted by “AIR OCEAN MAROC” (Hereinafter referred to as “AOM“) located at No1 Battani Street, Agdal, Rabat, Morocco for the provision of Air Ambulance Services (Hereinafter referred to as “Service“). Deviation from the terms and conditions stipulated below shall only be valid in the case of a written confirmation from AOM.

1. Flight Confirmation: This Contract will only be binding in the case that the client accepts the offer submitted by AOM in written form. The receipt of written confirmation from the client shall not be considered as a confirmation of Services by AOM and shall be subject to aircraft availability, medical clearance of the patient, obtaining traffic-rights, overflight permits, slots, and all necessary governmental and operational approvals. In the case that authorizations related to performance of Services are not granted by 3rd parties, AOM shall not be held liable for such AOM shall not be held liable for such cases. In such circumstances, AOM reserves its right to ask compensation from the client for the expenses incurred.

2. Cost of Service: The quotation covers the price of air ambulance service on the mentioned route with standard medical team (one medical doctor and nurse/paramedic) and standard medical equipment. The items that are not included in the quotation are detailed under Article 3.

3. Extra Costs: Additional costs including but not limited to de-icing of the ambulance aircraft, war risk insurance, royalties, customs, airport working hours extension, visa clearance, ground time over 2 hours etc. will be charged separately with an additional 7% handling fee.

4. Provision of Information & Documentation: Provision of necessary information and documentation (including but not limited to medical facility details, ground transport details, latest medical report of the patient, travel documents, and identity card) before the commencement of Services is the obligation of the client. AOM has right to decline or cancel the Services in the cases that lack of information /documentation provided by the client or non-compliance with relevant regulations are observed. In no way, AOM shall be kept liable for the losses arising as a result of client’s acts.

5 Flight at Sea-Level: Depending on the medical condition of the patient, if it is decided by AOM medical team, either before or during the flight, that the flight cannot be carried out under normal flying conditions and that the medical condition of the patient requires transportation at sea / low level, 10% of the total quotation will be additionally charged to the client. Such changes in Services will be stated in the patient’s medical transportation report and reported to the client if there are any.

6. Delay in Operations by Client: If delays occur due to the fault of the client, AOM shall have right to charge such expenses to the Client.

7. Assessment of Patient’s Medical Condition: In any case AOM reserves the right to decline the flight after clearing the diagnosis and the latest medical situation of the patient. If the medical condition of the patient is too serious at the time of estimated departure or does not correspond with the medical report provided by the client; AOM reserves the right to refuse the transportation of the patient for the sake of patient’s welfare. In such case full-Service cost will still be charged to the client.

8. Companion on Board: Depending on the medical condition of the patient, AOM reserves the right to decide whether a companion will be allowed on board or not.

9. Luggage: AOM reserves the right to determine the amount of luggage or load to be taken on board. Standard allowable baggage on board is two hand bags or one suitcase. AOM has always right to check the luggage for security reasons.

10. Payment Terms: Unless otherwise agreed in written, the total cost of Services shall be transferred to AOM’s account before the take- off. AOM shall not held liable for any delay that may arise in relation to late payment. AOM has also right to invoice extra cost that incurs as a result of the late payment of the Service cost. In the cases that the Client will make payment with Credit Card, 3% of quoted price will be charged to the Client.

11. Cancellation Policy: Following In the event of flight cancellation by either the requesting Provider or the client, the cancellation costs will be invoiced according to the following :

● If Flight is cancelled after activation, 25% of quoted amount shall be invoiced.
● If Flight is cancelled less than 72 Hours prior to the first flight of the Flight Schedule, 50% of quoted amount shall be invoiced. ● If Flight is cancelled less than 12 hours prior to the first flight of the Flight Schedule, 100% of quoted amount shall be invoiced.

12. Cancellation of a Flight: Under inconvenient weather conditions, due to technical problems or related to any unforeseen problems that are beyond AOM’s control; AOM reserves the right to re-schedule the flight program or to cancel the flight.

13. Validity of Quotation: Unless otherwise agreed in written; this quotation is7 (seven) days valid/limited.

14. Protection of Personal Data

No personal data is collected without your knowledge. In a commitment to respect privacy, Air Ocean Maroc ensures that the collection and processing of personal data are carried out in accordance with Law No. 09-08 of February 18, 2009, concerning the protection of individuals regarding the processing of personal data.

No personal data is transferred to third parties.
